1. Business Identity and Agreement

These Terms of Service (“Terms”) govern your access to and use of the services provided by New Life Teleheal operating as New Life Heal (“we,” “us,” or “our”), registered at 5001 Sergeant Bluff Rd, Suite 50, Sioux City, IA 51106.

By accessing our website (newlifeheal.com), downloading our mobile application, creating a patient account, or using our telehealth and in-person wellness services, you agree to be bound by these Terms. If you do not agree with these Terms, you may not access or use our platforms or services.

2. SMS and Communication Program

By providing your phone number and opting into our communication program, you agree to receive text (SMS) messages related to your care from New Life Teleheal.

•Program Description: Messages may include appointment reminders, confirmations, health updates, follow-up communications, patient reactivation messages, and responses to your inquiries.

•Opt-Out Instructions: You can cancel the SMS service at any time by texting STOP to any message received from us. After sending STOP, you will receive a final one-time confirmation message and will no longer receive SMS messages from New Life Teleheal. To re-subscribe, you must sign up again through our website or contact us directly.

•Help & Support: For help, reply HELP to any message or contact us at (432) 878-4660 or info@newlifeheal.com.

•Message Frequency: Frequency varies based on your appointment schedule and interactions with our team. You may receive up to several messages per month.

•Carrier Liability: Mobile carriers are not liable for delayed or undelivered messages.

•Message & Data Rates: Standard message and data rates may apply. For questions about your text or data plan, please contact your wireless provider.

3. User Accounts

To access the New Life Heal mobile application and patient portal, you must create a user account. You are responsible for:

•Providing accurate and complete information.

•Safeguarding your password and account security.

•Notifying us immediately of any unauthorized account use.We reserve the right to suspend or terminate accounts that provide fraudulent information or violate these Terms.

4. Telehealth Services

New Life Heal provides concierge telehealth wellness services in Texas and Iowa.

•Telehealth Limitations: Telehealth involves electronic communications and has limitations compared to in-person care, such as the inability to perform physical examinations.

•Provider-Patient Relationship: A relationship is established only after an initial consultation and provider acceptance.

•Licensure: You must be physically located in Texas or Iowa during your telehealth consultation to comply with state medical board requirements.

5. Medical Disclaimer

•Not Individualized Advice: Content on our app, website, and educational courses is for informational purposes and does not constitute individualized medical advice.

•EMERGENCY NOTICE: OUR PLATFORM IS NOT FOR EMERGENCIES. IF YOU ARE EXPERIENCING A MEDICAL EMERGENCY, CALL 911 OR GO TO THE NEAREST EMERGENCY ROOM IMMEDIATELY.

6. Prescription and Refill Policy

•Provider Discretion: All medication requests, including GLP-1 therapy and hormone optimization, are subject to review by a licensed provider. Approval is not guaranteed.

•Requirements: Providers may require laboratory testing or follow-up telehealth visits before issuing or refilling prescriptions.

7. Memberships and Billing

•Subscriptions: By enrolling in a membership program, you authorize us to charge your provided payment method (via Stripe) for recurring fees.

•Cancellation: Subscriptions must be cancelled according to the policy provided at enrollment. Fees for medical services and dispensed medications are generally non-refundable.

8. Acceptable Use

You are prohibited from:

•Sharing your account or secure messaging access with others.

•Providing false health or identity information.

•Reverse engineering the mobile application.

•Using the messaging system for abusive or inappropriate content.

9. Intellectual Property

The New Life Heal name, logos, branding, educational videos, and mobile application code are the exclusive property of New Life Teleheal and are protected by copyright and trademark laws.

10. Limitation of Liability

To the fullest extent permitted by law, New Life Heal and its providers shall not be liable for any indirect, incidental, or consequential damages resulting from your use of the website, app, or services. Our aggregate liability shall not exceed the amount you paid us in the past twelve months.

11. Governing Law

These Terms are governed by the laws of the State of Iowa. Any disputes will be resolved exclusively in the courts located in Woodbury County, Iowa.
